1.1 This website is operated by S247 PLC, trading as MacGregor Golf (referred to in these Terms as “we”, “us”, “our” or “MacGregor Golf”). We are a public limited company registered in England and Wales under company number 06151896. Our registered office is at 4 Wellington Circus, Nottingham, Nottinghamshire, NG1 5AL. Please note this address is NOT for returns or general correspondence — see clause 1.3 for our postal address.

2. These Terms
2.1 These Terms and Conditions (“Terms”) govern your use of our Website and any purchase you make from us. They should be read alongside our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
2.2 We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date. We reserve the right to make modifications without prior notice. Your continued use of the Website after any changes constitutes your acceptance of the revised Terms.
2.3 These Terms are written in English and apply to consumers and business customers. If you are purchasing from outside the United Kingdom, different considerations may apply in respect of import duties, taxes and consumer rights.
3. Use of This Website
3.1 Permitted Use
You may use our Website for lawful purposes only and in a manner consistent with all applicable laws and regulations. You must not:

- Use the Website in any fraudulent or deceptive manner, or for any unlawful purpose;
- Transmit unsolicited commercial communications (spam);
- Knowingly introduce viruses, trojans, worms, logic bombs or other malicious code;
- Attempt to gain unauthorised access to any part of the Website, its servers, or any connected systems;
- Reproduce, duplicate, copy, sell or exploit any portion of the Website without our prior written consent.

3.2.1 All content on this Website, including but not limited to text, images, graphics, logos, product photographs, videos, audio, software and page layouts, is owned by or licensed to us and is protected by copyright, trade mark and other intellectual property laws.
3.2.2 The MacGregor Golf name, logo and all related product names are registered trade marks of their respective owners. You may not use them without prior written permission.
3.2.3 You may print or download content from our Website for your own personal, non-commercial use only, provided you do not modify the materials and you retain all copyright notices.
3.3 Accuracy of Website Information
3.3.1 We make every attempt to accurately represent the products that we sell. However, product images and illustrations are intended as a guide only and may not be identical to the actual supplied product, as manufacturers may modify their products without notice.
3.3.2 Please note that different computer screens, operating systems and web browsers have different colour characteristics. It is therefore not possible to guarantee that a colour shown on screen will fully reflect the true colour of the product being purchased.
3.3.3 We reserve the right to make any changes to a product description or illustration at any time without notice.
4. Orders and Contract Formation
4.1 Our Website constitutes an invitation to treat. Your submission of an order constitutes an offer to purchase goods from us on these Terms.
4.2 No contract is formed between us until we send you a formal dispatch confirmation by email. An automated order acknowledgement is not an acceptance of your order. We are not liable for customers failing to receive such emails; it is your responsibility to ensure your email address is correctly entered at checkout.
4.3 We are entitled to take payment prior to the acceptance and finalisation of a contract. The taking or earmarking of funds does not indicate our acceptance to commence contractual relations.
4.4 We reserve the right to cancel any order at our own discretion without notice, including if:
- A product is out of stock or discontinued;
- We are unable to obtain authorisation for your payment;
- A pricing or product description error has occurred;
- We reasonably suspect fraudulent activity.
4.5 If we cancel an order after payment has been taken, we will issue a full refund to your original payment method.
4.6 You must be at least 18 years old to place an order on our Website.
4.7 Any order containing personalised, customised or custom-fitted products must be placed online. It is your responsibility to ensure your specification is correct prior to submission. We reserve the right to alter, adjust or modify any image or text submitted for personalisation solely to improve the quality of the finished product.
5. Prices and Payment
5.1 All prices are displayed in pounds sterling (£) and are inclusive of VAT at the applicable rate. Delivery charges are shown separately at checkout. VAT receipts are available on request by emailing help@macgregorgolf.co.uk.
5.2 If we discover a pricing error after you have placed an order:
- Where the correct price is lower than stated, we will charge the lower price and proceed with your order;
- Where the correct price is higher than stated, we will contact you and offer the option to proceed at the correct price or cancel for a full refund.
5.3 We accept payment by credit and debit card, processed securely via Stripe (supporting Visa, Mastercard and other major card schemes), and by PayPal. We do not store your full card details on our systems.
5.4 Promotional discount codes must be entered at checkout and cannot be applied retrospectively. Only one code may be used per order unless otherwise stated. Codes cannot be exchanged for cash.
5.5 VAT-registered customers wishing to reclaim VAT should email help@macgregorgolf.co.uk with their order reference and VAT number after checkout. A refund will be processed once the order has been dispatched and proof of VAT registration received.
6. Delivery
6.1 General
The majority of our products are held in our warehouse in Redditch. We offer same working-day dispatch on orders placed before 1pm, with next working day delivery available. Parcels are despatched Monday to Friday, excluding public holidays. The charges below apply to standard-sized items with a maximum length of 1.2m.

6.3 Delivery Timescales
Estimated delivery times are provided as a guide only and are not guaranteed. Deliveries are made Monday to Friday. We will not be liable for delays caused by circumstances outside our reasonable control (see clause 14).
6.4 International Deliveries — Customs, Duties and Taxes
Orders shipped outside the United Kingdom may be subject to import duties, VAT or customs clearance fees levied by the destination country. These charges are not within our control and are entirely your responsibility. It is also your responsibility to ensure that goods may be lawfully imported into your country.
6.5 Risk and Title
Risk in the goods passes to you upon delivery. Title (legal ownership) passes to you upon receipt of full payment.
6.6 Failed Delivery
If a delivery attempt is unsuccessful, our courier will leave a card with instructions. If you do not respond within five working days, the parcel may be returned to our warehouse and you will be liable for re-delivery postage costs.
6.7 Damaged or Incorrect Items on Arrival
If your order arrives damaged or you receive an incorrect item, please contact us at help@macgregorgolf.co.uk within 14 days of receipt, including your order number, a description of the issue and photographs where possible. After 14 days, we reserve the right to refuse any potential remedy.
7. Returns, Refunds and Your Right to Cancel
7.1 Our 30-Day Returns Policy
You may return most new, unopened, stock items within 30 days of delivery for a full refund, provided the item is returned in its original, unused condition with all original packaging.
7.2 Who Pays for Return Postage?
If the return is the result of our error (incorrect or defective item), we will cover all return postage costs and arrange a pre-paid returns label. For all other returns (e.g. change of mind, ordering in error), you are responsible for the cost of returning the goods. You may use Royal Mail, any courier of your choice, or we can arrange a pre-paid label for you at cost.

7.4 Statutory Right to Cancel (Consumer Contracts Regulations 2013)
In addition to our 30-day returns policy, if you are a consumer you have the right to cancel your contract within 14 days of receiving the goods without giving any reason. Our 30-day policy is more generous than this statutory minimum. The Model Cancellation Form at Appendix A is provided for statutory compliance purposes.
7.5 Faulty or Defective Goods — Your Statutory Rights
Nothing in these Terms affects your statutory rights. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If goods are faulty, damaged on arrival or misdescribed:
- Within 30 days of delivery: You may reject the goods and receive a full refund;
- After 30 days but within 6 months: You are entitled to a repair or replacement first. If that fails or is not possible, you may be entitled to a partial or full refund;
- After 6 months: You may still be entitled to a remedy, but you may need to demonstrate the fault existed at the time of delivery.
In the event of a faulty or incorrect item, we will repair or replace it and cover all return postage costs.
7.6 Non-Returnable Items
The following items cannot be returned:
- Custom items — any product where you have made a choice in the configuration (e.g. custom-fitted golf clubs, bespoke shaft builds, personalised or engraved items) and we have built or prepared that product to your specification;
- Used items — items that have been used (e.g. clubs that have been played with on a course, range or practice facility).
8. Business Customers
8.1 This clause applies where you purchase goods for business purposes. The consumer rights set out in clause 7 do not apply to business purchases.
8.2 Business customers must inspect goods upon delivery and notify us in writing of any defects or shortfalls within 7 working days. Failure to do so may affect your ability to make a claim.
8.3 Our liability to business customers is limited as set out in clause 12.
9. Product Warranties
9.1 Unless otherwise stated on the relevant product page, all new products come with a 12-month warranty. Ex-demonstration products carry a 6-month warranty. Warranties are personal to the original purchaser and are not transferable with ownership.
9.2 Our warranty provides full cover against mechanical breakdown through normal use. If your item develops a fault during the warranty period, we will arrange for it to be repaired free of charge, including parts and labour.
9.3 The warranty does not cover: accidental damage; consumables (batteries, bulbs, fuses, friction parts); cosmetic damage where product function is unaffected; products used commercially; data loss; deliberate damage or neglect; or failure to follow manufacturer’s instructions.
9.4 To make a warranty claim, email help@macgregorgolf.co.uk with your name, order number and a description of the fault, including photographs where possible.
9.5 Golf club specifications (loft, lie angle, shaft flex, grip size) are provided for guidance only and are based on manufacturer data. Actual performance may vary. We strongly recommend a professional club fitting before purchasing high-specification or custom equipment.
9.6 All golf equipment sold through this Website is intended for lawful recreational or competitive use in accordance with the Rules of Golf as published by The R&A and the USGA. We make no warranty that any product conforms to the rules or specifications of any particular golf club, tour, competition or governing body. It is your responsibility to verify conformity before entering any competition.
10. Intellectual Property and Trade Accounts
10.1 MacGregor Golf and all related product names and logos are trade marks of their respective owners. Nothing on this Website grants any licence or right to use any trade mark without prior written permission.
10.2 We are unable to offer reductions beyond those advertised on our public websites. For trade or bulk purchase enquiries, please visit www.sportssource.co.uk.
11. Data Protection and Privacy
11.1 We process personal data in accordance with our Privacy Policy. By using our Website and placing an order, you acknowledge such processing.
11.2 We are registered as a Data Controller with the Information Commissioner’s Office (ICO) under reference number [ICO REGISTRATION NUMBER].
11.3 We use cookies on our Website in accordance with our Cookie Policy and in compliance with the Privacy and Electronic Communications Regulations 2003 (PECR).
11.4 All calls to our customer service team may be recorded for quality monitoring and training purposes.
12. Our Liability
12.1 We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory consumer rights; and defective products under the Consumer Protection Act 1987.
12.2 If you are a consumer, we are only responsible for losses that are a reasonably foreseeable consequence of our breach of these Terms. We are not liable for any indirect or consequential loss, or for any loss of business or profit.
12.3 If you are a business customer, our total liability in connection with any order shall not exceed the value of that order. We shall not be liable for any indirect, consequential, loss of profit, revenue, data or reputational damage.
12.4 We are not responsible for the content of third-party websites linked to or from our Website.
13. WEEE Regulations
13.1 S247 PLC is a registered producer of Electrical and Electronic Equipment (EEE) under WEEE Compliance Scheme member Comply Direct. Our WEEE producer registration number is WEE/DC0065TW. Where applicable, electrical products sold through this Website must not be disposed of in general household waste. To find your nearest free recycling centre, visit www.recycle-more.co.uk.
14. Events Outside Our Control (Force Majeure)
14.1 We will not be liable for any failure or delay in performance caused by events outside our reasonable control, including acts of God, fire, flood, extreme weather, epidemic or pandemic, strikes, failure of third-party couriers, or changes in law. If such circumstances continue for more than 30 days, either party may cancel the affected order and you will receive a full refund.

15.2 If you are not satisfied with our response, you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Note that as the UK has left the EU, this platform may have limited availability for UK consumers.
16. Governing Law and Jurisdiction
16.1 These Terms are governed by the laws of England and Wales. You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales, save that consumers in Scotland or Northern Ireland may also bring proceedings in their local courts.
16.2 If you are a consumer, you will also benefit from any mandatory provisions of the law of your country of residence.
17. General
17.1 Severability: If any provision of these Terms is found invalid or unenforceable, the remaining Terms continue in full force and effect.
17.2 Waiver: Our failure to enforce any right shall not constitute a waiver of that right.
17.3 Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between us regarding your use of this Website.
17.4 Third Parties: No third party has any right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.
17.5 Assignment: We may assign our rights and obligations under these Terms to another organisation and will notify you if this happens. You may not transfer your rights without our prior written consent.
